⚡ QUICK ANSWERW-8BEN = the IRS form submitted by non-US individuals to US payers that stops 30% withholding and applies your treaty rate. Requires your ITIN. Submit separately to each platform (Amazon KDP, YouTube AdSense, Upwork, Fiverr, brokerages). Expires every 3 years — resubmit before expiry.
What Is Form W-8BEN?
Form W-8BEN, Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding and Reporting (Individuals), certifies to a US payer that:
- You are NOT a US citizen or US resident alien (you are "foreign")
- The income being paid to you is your own (you are the "beneficial owner")
- If your country has a US tax treaty, you are claiming the reduced withholding rate under that treaty
Without W-8BEN, US payers default to 30% withholding on passive income (royalties, rent, interest) and 24% backup withholding on other payments. With a valid W-8BEN + ITIN, the rate drops to your treaty rate (0–15%) or confirms 0% on service income earned outside the USA.
W-8BEN vs W-8BEN-E — Which One?
| Form | Who Uses It | TIN Required |
| W-8BEN | Non-US individuals (you personally) | ITIN (9XX-XX-XXXX) |
| W-8BEN-E | Non-US business entities (foreign company, foreign LLC) | EIN or foreign TIN |
If you sell on Amazon KDP as an individual author, freelance on Upwork as yourself, or earn AdSense revenue in your name — use W-8BEN with your ITIN. If your US LLC (or foreign company) is the recipient of income — use W-8BEN-E with the entity's EIN.
W-8BEN Line-by-Line Completion Guide
Line 1 — Name of Individual
Your full legal name exactly as on your passport. First name + last name.
Example: Ahmed Waqas (not "A. Waqas" or "Waqas Ahmed")
Line 2 — Country of Citizenship
Your passport's country. This determines which treaty (if any) you can claim.
Example: Pakistan / United Kingdom / India / Germany
Line 3 — Permanent Residence Address
Your actual current address, including country. Do not use a US address or PO Box here — it must be foreign.
Line 5 — U.S. Taxpayer Identification Number (ITIN)
Enter your ITIN in the format 9XX-XX-XXXX. This is the critical field — without it, the platform cannot validate your treaty claim and defaults to 30% withholding.
Example: 988-76-5432
Line 6a — Foreign Tax Identifying Number
Your national TIN in your home country (if applicable). Optional but recommended. Examples: CNIC for Pakistan, PAN for India, NIF for Germany.
Line 9 — Claim of Tax Treaty Benefits (Country)
Enter your country of tax residence. This is the country whose treaty you're claiming — usually same as your citizenship country. Only fill this section if your country has a US tax treaty with a favorable royalty rate.
Line 10 — Special Rates and Conditions
Enter the specific treaty article and the rate you're claiming. Example for a UK author claiming 0% royalties: "Article 12, 0%, royalties from literary, artistic, or scientific work."
UK: Article 12 — 0% | Germany: Article 12 — 0% | Australia: Article 12 — 5% | India: Article 13 — 15%

Where to Submit W-8BEN — Platform Guide
W-8BEN Expiration — Don't Let It Lapse
W-8BEN is valid for the calendar year signed plus 3 full calendar years. Examples:
- Signed January 15, 2024 → expires December 31, 2026
- Signed July 2023 → expires December 31, 2025 (already expired)
- Signed October 2025 → expires December 31, 2027
⚠️ What happens when W-8BEN expires: The platform reverts to 30% or 24% withholding automatically. Some platforms notify you — many don't. Set a calendar reminder every 3 years. Submit a fresh W-8BEN to each platform before the current one expires. Your ITIN remains valid (unless also expired) — just resubmit the W-8BEN form itself.

FAQs — W-8BEN
Do I need an ITIN to submit W-8BEN?
You can submit W-8BEN without an ITIN on some platforms (certifying non-US status only, without treaty claim). However, you cannot claim a treaty rate without entering a US TIN (ITIN) on Line 5. Without an ITIN, platforms may accept the form for non-US certification but will apply 30% withholding because they cannot validate the treaty claim without a TIN. Get your ITIN to unlock the reduced rate.
Do I submit a new W-8BEN to each platform separately?
Yes. Each US platform is an independent "withholding agent." Each platform needs its own W-8BEN on file. Submitting to Amazon KDP does not automatically apply to AdSense, Upwork, or any other platform. Submit separately to each one.
My country has no US tax treaty — should I still submit W-8BEN?
Yes — absolutely. Even without a treaty, W-8BEN certifies your non-US status. For service income (Upwork, Fiverr work performed outside the USA), W-8BEN stops backup withholding (24%). The 30% withholding rate only applies to passive income (royalties, rent, interest) — and W-8BEN documents your status even if no treaty reduces that rate. Always submit W-8BEN.
What's the difference between W-8BEN and W-9?
W-9 is for US persons — US citizens and US residents certifying their US status and SSN/ITIN. W-8BEN is for non-US persons certifying their foreign status. Never submit W-9 if you are a non-US person — it tells the IRS you are a US resident and triggers US tax reporting obligations.
