Nigeria has no comprehensive income tax treaty with the United States. All US-source income is subject to standard withholding rates. An ITIN ensures your payments are processed correctly.
With the naira losing significant value, every dollar earned from US platforms matters. An ITIN unlocks full access to US payment platforms and protects your earnings.
You Got a 1099. Now What?
Receiving a 1099 form from a US client means the IRS has been told about your income. If you're a Nigerian freelancer, consultant, or business owner who received a 1099-NEC (for freelance payments) or 1099-K (from payment platforms), action is required.
Ignoring a 1099 creates potential tax compliance issues. Taking the right steps โ starting with obtaining an ITIN โ resolves the situation correctly.
Types of 1099 Forms Nigerians Receive
- 1099-NEC โ Non-Employee Compensation. Sent by US clients who paid you $600+ during the year for services. This is what US startups, agencies, and businesses send their Nigerian contractors.
- 1099-K โ Payment Card and Third Party Network Transactions. Sent by payment platforms (Stripe, PayPal, Amazon, Upwork) when you receive $600+ in a year.
- 1099-MISC โ Miscellaneous income. For royalties, rents, and other income types not covered by the above.
- 1042-S โ Foreign Person's US Source Income Subject to Withholding. The non-resident equivalent of a 1099. This form already had tax withheld.
Why the 1099 Was Issued to Your Tax ID
Your US client collected your information (possibly on a W-9 if you incorrectly filled one out, or a W-8BEN) and reported your payments to the IRS. If you provided a fake or incorrect tax ID, this creates a mismatch in IRS records.
If you have no US tax ID, the IRS records the payment without matching it to a return. This can trigger compliance issues if the amounts are significant.
What to Do After Receiving a 1099
- Don't ignore it โ the IRS has record of this income. Address it proactively.
- Get ITIN via ITIN Plus โ $99, 8โ14 weeks. Your ITIN is the foundation for everything that follows.
- File Form 1040-NR โ the US non-resident return reports your US income, applies deductions, and reconciles any withholding.
- For future payments โ provide your ITIN on a properly completed W-8BEN to prevent future withholding and ensure 1099s are correctly issued.
- Report in Nigeria โ ensure your foreign income is properly reported to FIRS as required by Nigerian tax law.
Will I Owe US Tax on My 1099 Income?
For service income (ECI โ Effectively Connected Income), the rate is graduated from 10โ37% on net income after deductions. If you had legitimate business expenses related to the services, these reduce your taxable income significantly. A US CPA can prepare your 1040-NR to minimize your US tax liability.
