What Is Form 1040-NR?

Form 1040-NR, U.S. Nonresident Alien Income Tax Return, is the IRS annual income tax return for non-resident aliens. "Non-resident alien" means a person who is not a US citizen and does not meet the IRS "substantial presence test" for US residency.

Form 1040-NR is structurally similar to the regular Form 1040 (used by US citizens and residents) but has different sections for US-source versus foreign-source income, treaty benefit claims, and FIRPTA transactions.

Using Form 1040-NR to Recover Withheld Tax

The most common reason non-US persons file Form 1040-NR is to recover excess withholding. Here's how each type of recovery works:

FIRPTA Withholding Recovery

15% was withheld at closing when you sold US real estate. Your actual capital gains tax may be lower. File 1040-NR to report the actual gain, calculate the true tax, and claim a refund of excess. Use Form 1042-S from closing as documentation of withholding.

Royalty Withholding Recovery (KDP, AdSense, Licensing)

Amazon KDP and YouTube AdSense withheld 30% on US-viewer royalties before you submitted a W-8BEN with ITIN. Now that you have an ITIN, you can file 1040-NR to report those royalties and claim treaty-reduced rates. The 1042-S issued by Amazon/Google documents the withholding. File for up to 3 prior years.

💡 3-year lookback: You can file Form 1040-NR to claim a refund of excess withholding for the 3 most recent tax years. If Amazon withheld 30% on your KDP royalties in 2023, 2024, and 2025 and you're a UK author entitled to 0%, you can recover 3 years of over-withholding by filing 1040-NR for each year.

Backup Withholding Recovery

Form 1040-NR Filing Deadlines

⚠️ 3-year refund statute of limitations: You can only claim a refund for tax years within 3 years of the original return due date. For tax year 2022 (due June 15, 2023), the refund claim deadline is June 15, 2026. After that date, any excess 2022 withholding is permanently forfeited.

Do I need Form 1040-NR if I only have Upwork income from outside the USA?
Generally no. Service income earned by a non-US person for work performed outside the USA is foreign-source income — not subject to US tax or filing requirements. However, if Upwork applied backup withholding (24%) on your payments before you submitted W-8BEN, you can file 1040-NR to recover that withholding by documenting the foreign-source nature of your income.
Can my tax advisor file Form 1040-NR without my ITIN?
No. Your tax advisor can prepare the return and file for an extension, but the return itself cannot be submitted without your ITIN in the TIN field. Apply for ITIN now and coordinate filing timing with your tax advisor.
